A purchaser approached me after waiting more than seven years for strata title issuance on a completed condominium unit. The developer had obtained the certificate of fitness but failed to submit the requisite documents to Jabatan Ukur dan Pemetaan Malaysia within the statutory period prescribed under the Strata Titles Act 1985.
I advised the client on the available remedies under the Housing Development (Control and Licensing) Act 1966 and the Strata Management Act 2013, and assisted in lodging a formal complaint with the Tribunal for Homebuyer Claims. The developer subsequently engaged and agreed to an expedited title registration process.
The strata title was issued within four months of the tribunal filing, and the client received compensation for the unreasonable delay. The matter highlighted the importance of monitoring the Housing Development Account and understanding the developer’s statutory obligations post-completion.
